Hints at Judge Roberts' Rulings

President Bush's nominee to the Supreme Court doesn't have much of a paper trail. The Associated Press digs up a case involving a shopping mall and a toad to get a look at his line of thinking.

On the appealate court, Judge Roberts ruled in favor of a shopping mall owner. He'd complained about having to move a fence around his business to accommodate the arroyo toad's migration.

The toad won in the end.

Judge Roberts' minority opinion suggests he wants to keep the feds out of local business affairs. It also shows a willingness to limit Congress' regulation of businesses. That's likely to win him friends among business lobbyists as they chat up Senators on the Hill. (Miami Herald)
